Vithya murder case Vijayakala informed Police to arrest ‘Swiss Kumar’ – CID

The CID informed Kayts Magistrate, A.M.M. Riyal, on 22 August that when the main suspect in the murder and rape of student Vithya Shivaloganathan, Mahalingam Shashikumar alias 'Swiss Kumar' had been tied to a lamppost and was being assaulted by the residents of......the area, it was State Minister of Children's Affairs Vijayakala Maheshwaran who had informed the Police to take him into custody.

The CID told the Court that the State Minister had got to know only on the following day after a meeting held at the Velanni Pradeshiya Sabha, that the suspect 'Swiss Kumar' had been released after being taken into custody. In addition, since the suspect Swiss Kumar had been released, within the jurisdiction of the Jaffna Magistrate's Court, former Kayts Magistrate Mohammed Mihal had previously ordered to find out whether there was a possibility of hearing the case at the Kayts Magistrate's Court.

Later, the Attorney General's Department had informed the Kayts Magistrate, that the complaint regarding the release of the suspect, Swiss Kumar, could be taken up for hearing at the Kayts Court.

The Attorney General's Department had informed the Court that since Sub-Inspector of Police Sri Jagan had taken Swiss Kumar into custody, within the jurisdiction of the Kayts Court, on a charge of murdering a schoolgirl, that too within the jurisdiction of the Kayts Magistrate Court, there was on obstruction to then case being heard in the Kayts Court. Meanwhile, subject to the Court ordering the CID to obtain a statement from State Minister of Children's Affairs Vijayakala Maheshwaran in connection with the release of the suspect, the CID informed the Court that a statement had been recorded from the State Minister.

According to that statement, subsequent to the murder of the girl Vithya, Maheshwaran had handed over to the Kayts Police, the names of several suspects, based on information provided by area residents and on a later date, when Swiss Kumar had been caught and tied to a lamp post, she had informed the Police and requested the people not to assault him but to hand him over.

This statement was presented to the Court by the CID.
