Tissa gang-rape victim dies Suspects could be tried for murder

Three youths arrested on suspicion of carrying out the Tissamaharama gang-rape can be charged with capital murder under Section 294 of the Penal Code, said President of the Bar Association of Sri Lanka, President's Counsel Udaya Rohan de Silva, following the death of the victim yesterday (15).

The 14-year-old girl had attempted suicide following the rape and died, while receiving treatment at the Intensive Care Unit (ICU) of the Hambantota General Hospital.

Section 294 of the Penal Code deals with the offence of culpable homicide or murder, while Section 363 of the Penal Code deals with......rape, and Section 363(e) deals with statutory rape.

Speaking to Ceylon Today, senior Counsel said that the Attorney General may decide to further prosecute on the aforementioned grounds, apart from charges of rape and statutory rape for having sexual intercourse with a girl under the age of 16 with or without her consent.

The girl was initially hospitalized on 10 January by her family members after she had attempted suicide, Police Spokesman SP Ruwan Gunasekara told Ceylon Today. She was treated in the ICU until 14 January but had later passed away and a post-mortem is yet to be conducted. During investigations, Police had discovered a suicide note written by her, alleging that three young boys had raped her on 9 January. It was also revealed that she had a love affair with one of the suspects.

The suspects were later arrested and produced in Court and ordered to be remanded till 23 January, Gunasekara added. Further investigations are being carried out by the Weerawila Police.
